La casa pertany a tots dos, sense estar establert quines parts f\u00edsiques de la mateixa s\u00f3n de cadascun. El cas m\u00e9s normal \u00e9s que cadascun tingui el 50% de la propietat, per\u00f2 no es delimita si el bany \u00e9s d&#8217;un o la cuina de l&#8217;altre. Qui cedeix la seva part sol ser compensat econ\u00f2micament pel titular que adquireix la plena propietat del b\u00e9 immoble.<\/p>\n<p>La parella pot optar entre acudir al notari per a signar l&#8217;escriptura d&#8217;extinci\u00f3 de condomini o b\u00e9 pot optar per fer-ho a trav\u00e9s del Conveni Regulador de mutu acord que ha d&#8217;acompanyar a la seva demanda de divorci, ja que a trav\u00e9s d&#8217;aquest conveni es pot procedir a l&#8217;extinci\u00f3 del condomini per voluntat m\u00fatua de tots dos c\u00f2njuges. Els actes realitzats dins d&#8217;aquest Conveni Regulador aprovat judicialment i havent-se expedit el corresponent manament judicial ho fa inscriptible en el Registre de la Propietat.<\/p>\n<p>Una novetat introdu\u00efda per la Llei 42\/2015 permet a la parella que decideix divorciar-se de manera contenciosa\u00a0 pugui acumular, a la petici\u00f3 de divorci, l&#8217;acci\u00f3 de la divisi\u00f3 de la copropietat sobre el domicili familiar.<\/p>\n<p>Per la Llei 42\/2015, de 5 d&#8217;octubre, amb entrada en vigor el 7 d&#8217;octubre, s&#8217;afegeix un apartat 4 a l&#8217;article 437 de la LEC, recollint com a excepci\u00f3 a la regla general de no acumulaci\u00f3 objectiva d&#8217;accions en els judicis verbals l&#8217;acci\u00f3 d&#8217;extinci\u00f3 del condomini:<\/p>\n<p style=\"text-align: justify;\">&#8220;<em>4.\u00aa En los procedimientos de separaci\u00f3n, divorcio o nulidad y en los que tengan por objeto obtener la eficacia civil de las resoluciones o decisiones eclesi\u00e1sticas, cualquiera de los c\u00f3nyuges podr\u00e1 ejercer simult\u00e1neamente la acci\u00f3n de divisi\u00f3n de la cosa com\u00fan respecto de los bienes que tengan en comunidad ordinaria indivisa. Si hubiere diversos bienes en r\u00e9gimen de comunidad ordinaria indivisa y uno de los c\u00f3nyuges lo solicitare el tribunal puede considerarlos en conjunto a los efectos de formar lotes o adjudicarlos<\/em>&#8220;.<\/p>\n<h2>Divisi\u00f3 de la cosa comuna<\/h2>\n<p style=\"text-align: justify;\">Al fil de l&#8217;anterior, si la parella no estigu\u00e9s casada i un dels dos no estigu\u00e9s conforme a extingir la copropietat, l&#8217;altre podr\u00e0 instar un procediment de divisi\u00f3 de cosa comuna pel qual es declari la dissoluci\u00f3 de la comunitat de b\u00e9ns formada pels copropietaris.<\/p>\n<p style=\"text-align: justify;\">Aquest <strong>procediment de divisi\u00f3 de cosa comuna<\/strong> es pot interposar en qualsevol cas en qu\u00e8 una de les parts sigui copropiet\u00e0ria juntament amb altres sobre un b\u00e9 indivisible. En aquesta mena de processos, el que se sol\u00b7licita \u00e9s que es declari la proced\u00e8ncia de la dissoluci\u00f3 de la comunitat de b\u00e9ns, que s&#8217;adjudiqui a qualsevol de les parts i, en cas de no adjudicar-se a cap de les parts, es procedeixi a la venda d&#8217;aquest immoble mitjan\u00e7ant subhasta, que haur\u00e0 de celebrar-se en el propi jutjat amb el degut repartiment del preu obtingut entre els comuners en proporci\u00f3 a les seves participacions, una vegada dedu\u00efts les despeses que per tal motiu s&#8217;originin, tenint en compte tamb\u00e9 que s&#8217;ha de saldar el pagament de la hipoteca que grav\u00e9s la finca en el qual caso que exist\u00eds.<\/p>\n<h2>Problem\u00e0tica de l&#8217;extinci\u00f3 si hi ha hipoteca<\/h2>\n<p>El problema m\u00e9s com\u00fa de les separacions de parelles, que van comprar una casa mitjan\u00e7ant un pr\u00e9stec hipotecari, ve en el moment de l&#8217;extinci\u00f3 de condomini. Es pot pactar que un dels separats o divorciats adquireixi el 100% de l&#8217;immoble, per\u00f2 aix\u00f2 no obliga a l&#8217;entitat financera creditora. \u00c9s a dir, que per molt que un accepti cedir el seu proindiv\u00eds a la ex-parella, el deute hipotecari no es veu afectat. Si el banc en q\u00fcesti\u00f3 no accepta llevar a un dels deutors, signant una extinci\u00f3 de condomini es perd la propietat del b\u00e9 per\u00f2 es continua sent deutor de la hipoteca.<\/p>\n<p>Perqu\u00e8 un deixi de ser propietari i alhora deutor hipotecari, \u00e9s necessari que l&#8217;entitat financera aprovi un nou pr\u00e9stec hipotecari en el qual el cedent no figuri com a deutor (titular hipotecari). Nom\u00e9s aix\u00ed l&#8217;operaci\u00f3 \u00e9s satisfact\u00f2ria per a totes dues parts, un perqu\u00e8 es queda la casa i el deute, l&#8217;altra perqu\u00e8 cedeix la casa per\u00f2 deixa de ser deutor. Per a aix\u00f2, en el moment de la signatura en notaria cal rubricar primer una hipoteca a nom del nou propietari ple (amb avalistes si aix\u00ed ho ha pactat amb el banc), en la qual nosaltres no figurem, per a despr\u00e9s signar l&#8217;escriptura d&#8217;extinci\u00f3 de condomini.<\/p>\n<p><strong>Marina Mullor<\/strong> afegeix un cas m\u00e9s complex, quan l&#8217;extinci\u00f3 de condomini s&#8217;ha previst mitjan\u00e7ant Conveni Regulador. Explica l&#8217;advocada experta en aquests temes que en aquest cas \u00e9s impossible realitzar l&#8217;extinci\u00f3 de condomini i la modificaci\u00f3 de l&#8217;escriptura hipotec\u00e0ria per la qual s&#8217;allibera una de les parts de la seva posici\u00f3 deutora en unitat d&#8217;acte, ja que l&#8217;entitat banc\u00e0ria sol sol\u00b7licitar el Conveni Regulador signat per a procedir a modificar el pr\u00e9stec hipotecari. En aquest cas, recomanar\u00edem que en primer lloc s&#8217;acud\u00eds a l&#8217;entitat banc\u00e0ria perqu\u00e8 el departament corresponent (normalment riscos) estudi\u00e9s la viabilitat que el pr\u00e9stec hipotecari subscrit qued\u00e9s nom\u00e9s a nom d&#8217;un titular; en aquesta fase solen demanar el Conveni Regulador pel qual s&#8217;extingeix la copropietat per\u00f2 el que hem d&#8217;aportar \u00e9s un esborrany del mateix informant de manera clara que si no es garanteix la sortida d&#8217;una de les parts de la posici\u00f3 deutora el mateix no se signar\u00e0. Una vegada obtinguda la viabilitat o no de la petici\u00f3 sol\u00b7licitada (normalment o sol\u00b7liciten fiadors o canvien les condicions respecte al pr\u00e9stec origin\u00e0riament pactat), es pot procedir a la signatura del Conveni pel qual s&#8217;extingeix la copropietat per a remetre&#8217;l a l&#8217;entitat banc\u00e0ria i que procedeixin a la signatura de la nova escriptura. \u00c9s molt important, a costa de ser reiteratius, insistir que la signatura de l&#8217;extinci\u00f3 de la copropietat per Conveni Regulador no implica que l&#8217;entitat banc\u00e0ria modifiqui el seu contracte de pr\u00e9stec hipotecari. Si no tenim clara aquesta circumst\u00e0ncia, es poden donar situacions en les quals deixem de ser copropietaris d&#8217;un immoble per\u00f2 continuem sent titulars del pr\u00e9stec hipotecari. Llegir article de Marina Mullor sobre <a href=\"https:\/\/futurlegal.com\/2019\/05\/27\/extincion-de-condominio-sin-acuerdo\/\" target=\"_blank\" rel=\"noopener\">l&#8217;extinci\u00f3 de condomini sense acord<\/a>.<\/p>\n<p>Com ens explica <strong>Cristina Borrallo Fern\u00e1ndez<\/strong>, advocada especialitzada en dret mercantil:<\/p>\n<p>Quan la finca est\u00e0 hipotecada, existeix una tercera part en aquesta operaci\u00f3 d&#8217;extinci\u00f3 de condomini de la propietat que cal tenir present en tot moment, l&#8217;Entitat Banc\u00e0ria. Aquesta per a concedir el pr\u00e9stec hipotecari va taxar la finca en q\u00fcesti\u00f3 per a atorgar el pr\u00e9stec i al seu torn, va nomenar com a titulars hipotecaris al matrimoni.<\/p>\n<p>Amb la gran pol\u00e8mica de les execucions hipotec\u00e0ries, s&#8217;est\u00e0 donant precisament a con\u00e8ixer les febleses del nostre r\u00e8gim legal hipotecari i processal, perqu\u00e8 si b\u00e9 la finca hipotecada cobrir\u00e0 el deute en cas d&#8217;execuci\u00f3 i posterior subhasta, amb un 60% o 70% depenent del percentatge aplicable, si no es cobreix la totalitat de la mateixa (capital, interessos, interessos moratoris i costes del procediment) s&#8217;atacar\u00e0 el patrimoni personal dels deutors, \u00e9s a dir, qualsevol altres b\u00e9ns que tinguin o que en el futur puguin adquirir.<\/p>\n<p>Per tant, en extingir el condomini \u00e9s de vital import\u00e0ncia que un dels titulars desaparegui de l&#8217;operaci\u00f3 hipotec\u00e0ria, mitjan\u00e7ant novaci\u00f3 de la mateixa davant notari. Actualment aquesta operaci\u00f3 est\u00e0 sent pr\u00e0cticament impossible, perqu\u00e8 per a un banc un titular \u00e9s una garantia, fins i tot si \u00e9s la part feble (econ\u00f2micament parlant) de l&#8217;operaci\u00f3, no t\u00e9 ingressos estables ni altres b\u00e9ns.<\/p>\n<p>Per aquest motiu, abans fins i tot d&#8217;anar al banc amb intenci\u00f3 de fer desapar\u00e8ixer a un titular del deute, ja has de portar estudiades les possibles alternatives a aquest. \u00c9s a dir, el banc s\u00ed que podria acceptar un altre titular, i si \u00e9s solvent millor, o substituir-lo per avalistes solvents.<\/p>\n<p>Si ens trobem en la desagradable situaci\u00f3 de separar-nos i tenir un habitatge com\u00fa, \u00e9s important que ens assessorem amb bons advocats i, a m\u00e9s, amb economistes o un altre tipus d&#8217;experts hipotecaris de Futur Finances.
